Assembly of Spirit Enterprises LLC ("Assembly of Spirit Enterprises," "Designs By Spirit," "we," "us," or "our") respects your privacy and is committed to protecting the personal information entrusted to us.

This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information when you visit or use the Designs By Spirit website, use the Design A View Studio, create or manage an account, communicate with us, purchase or inquire about our products and services, participate in the Designs By Spirit Professional Network or other professional programs, or otherwise interact with Designs By Spirit.

For purposes of applicable privacy laws, Assembly of Spirit Enterprises LLC is the business or data controller responsible for the personal information described in this Privacy Policy unless otherwise stated.

1. Scope of This Privacy Policy

This Privacy Policy applies to Designs By Spirit services and digital properties made available to customers, prospective customers, design professionals, dealers, distributors, referral partners, commercial customers, and other visitors, including:

the Designs By Spirit public website;
the Design A View Studio;
online product visualization and augmented-reality features;
AI-assisted design and image-generation features;
account and saved-project functionality;
ordering, payment, shipping, customer-service, and warranty interactions;
the Designs By Spirit Professional Network and related dealer, distributor, design-professional, or referral-partner areas;
quote and commercial-project inquiries;
contact forms, email communications, and other communications with Designs By Spirit.

Internal employee systems and information collected solely in an employment context may be governed by separate policies.

2. Notice at Collection

Depending on how you interact with Designs By Spirit, we may collect the following categories of personal information:

Identifiers and contact information, such as your name, email address, telephone number, billing address, shipping address, account name, customer number, and similar identifiers.

Account and authentication information, such as your email address, account identifier, passwordless magic-link authentication records, session tokens, sign-in timestamps, and account-security information. The current Design A View Studio sign-in does not ask customers to create a password.

Commercial and transaction information, such as products viewed, product selections, measurements, saved designs, quotes, purchases, order history, electronic proofs and approval records, payment status, shipping information, tax calculations and jurisdiction details, transaction and refund references, returns, warranty requests, and customer-service history.

Design and project information, including window dimensions, room or project information, artwork selections, color or design preferences, crop and positioning choices, saved projects, product configurations, and similar information required to create or fulfill a customized Designs By Spirit product.

Photos, images, artwork, files, prompts, and other content you provide, including content uploaded to or created through the Design A View Studio.

Internet and electronic activity information, such as Internet Protocol address, browser type, device information, operating system, referring pages, pages visited, dates and times of visits, session information, error logs, and interactions with our website.

Approximate location information, which may be inferred from your IP address or similar technical information. We do not seek to collect precise geolocation information unless a particular feature clearly requests it and you choose to permit it.

Professional and business information, such as company name, professional role, business contact information, dealer or distributor information, resale or business documentation, territory information, project information, and information relating to participation in a Designs By Spirit professional program.

Communications, including emails, contact-form submissions, support inquiries, feedback, reviews, and other communications you send to us.

Preferences and inferences, such as product interests, saved preferences, design preferences, and information reasonably inferred from your interactions with the Services.

We collect and use this information for the purposes described in this Privacy Policy, including providing our products and services, processing orders, operating the Design A View Studio, communicating with you, preventing fraud, protecting our systems, improving our services, and complying with legal obligations.

We seek to limit collection of personal information to information that is reasonably necessary and proportionate to the purposes for which it is collected.

We retain personal information only for as long as reasonably necessary for the purposes for which it was collected, as described more fully below.

3. Information You Provide Directly to Us

We collect personal information when you voluntarily provide it to us. Examples include when you:

request product information or a quote;
place an order;
create an account;
save a design or project;
upload artwork, photographs, or other files;
enter product or window measurements;
use an AI-assisted design feature;
contact customer service;
submit a warranty, return, or shipping inquiry;
subscribe to communications;
apply for or participate in the Designs By Spirit Professional Network;
request marketing materials;
communicate with us about a residential, commercial, hospitality, healthcare, retail, design, or other project.

You are responsible for ensuring that you have the right to provide any information, images, artwork, photographs, or other content you submit to us.

Please avoid submitting sensitive personal information that is not necessary for the service you are requesting.

4. Design A View Studio Information

The Design A View Studio allows customers and professionals to visualize customized Designs By Spirit products.

Depending on the features you use, the Studio may process information such as:

window measurements and dimensions;
product specifications;
design selections;
artwork;
photographs or images you choose to upload;
saved projects;
design positioning and cropping information;
prompts submitted to AI-assisted design features;
generated images or designs;
technical information necessary to operate the Studio.

You may explore the Window Blind and Window Film Studios without signing in. Sign-in is requested only when you choose to save, reopen, rename, duplicate, renew, or delete a private design through My Designs.

My Designs uses the email address you provide to send a secure passwordless sign-in link. Designs By Spirit does not ask you to create a password for this feature. Authentication and account records may include your email address, a unique account identifier, session information, sign-in timestamps, and security or abuse-prevention information.

A saved draft may include the master artwork and Studio settings needed to reconstruct the project, such as product type, window measurements and spacing, artwork selection, positioning, text, colors, opacity, and other configuration choices. My Designs does not intentionally store duplicate room-preview or augmented-reality images when the master artwork and settings can recreate those views.

We use this information to provide the visualization service, create and save designs at your request, prepare products for ordering or production where applicable, provide customer support, maintain the security and functionality of the Studio, enforce reasonable fair-use limits, and improve the customer experience.

Electronic Proofs and Order Records

When you request an electronic proof or begin a Window Film Studio order, we create records associated with that order. If you approve the proof, we retain the approved proof version, design and measurement specifications, order reference, customer account or session identifier, email address provided, and approval date and time. We use these records to document your approval, prepare the correct product, provide order support, and resolve questions or disputes.

Delivery addresses, tax quotes, payment status, and related order records are stored separately from ordinary saved drafts. These records may be created even if you do not complete payment. Their retention is described in Section 17.

Information relating to our proprietary pricing, production, manufacturing, routing, processing, or other internal systems is not considered customer personal information merely because it is used internally to fulfill a customer request.

5. Camera, Photographs, and Augmented-Reality Features

Certain Design A View Studio features may request access to the camera on your phone, tablet, or other device so you can preview a design in your environment.

Camera access occurs only after permission is granted through your device or browser.

The live camera view is intended to be used solely to provide the requested visualization or augmented-reality experience. Designs By Spirit does not use Studio camera functionality for advertising, facial recognition, biometric identification, or unrelated surveillance.

We do not intentionally record or retain continuous camera video merely because you use an augmented-reality feature.

If a future Studio feature requires camera imagery to be transmitted to or processed by a remote server rather than solely within your device or browser, we will provide appropriate notice where required before that processing occurs.

If you intentionally capture, save, or upload a photograph or other image, the content will be treated as information you provided to us and may be retained as necessary to provide the requested feature or service.

Digital photographs can contain embedded metadata, which may include information about the device used to create the photograph and, in some circumstances, location information. Designs By Spirit does not intentionally use embedded image-location metadata for advertising, tracking, or profiling.

Our systems and operational practices are intended to avoid collecting or retaining unnecessary metadata where reasonably practicable. If metadata accompanies an uploaded file, it may nevertheless be technically processed as part of that file.

You should avoid uploading images containing sensitive information that is not necessary for your design.

You can disable camera permission through your browser or device settings, although doing so may prevent augmented-reality functionality from working.

6. AI-Assisted Design and Image Generation

Designs By Spirit may provide features that use artificial intelligence to assist with artwork creation, design concepts, image generation, modification, expansion, or visualization.

When you use these features, information you submit - such as text prompts, artwork, photographs, or other content - may be processed by technology providers acting on our behalf to generate the requested result.

We may use information submitted through AI-assisted features to:

provide the requested generation or design service;
deliver generated results;
save results at your request;
maintain and secure the service;
diagnose technical problems;
prevent fraud, abuse, or misuse;
comply with applicable law.

AI Training and Customer Content

Designs By Spirit does not intentionally use customer-submitted prompts, photographs, artwork, uploaded files, or private saved designs to train its own general-purpose artificial-intelligence models.

We do not intentionally opt customer content into third-party programs for training general-purpose AI models.

Where commercially available, we seek to select and configure AI service providers so that business and customer content is not used by those providers for independent general-purpose model training or advertising.

AI service providers may process or temporarily retain information as reasonably necessary to generate requested content, maintain service security, detect abuse, comply with law, or perform other functions permitted under their agreements with Designs By Spirit.

We do not authorize AI service providers to use customer personal information for their own independent advertising purposes.

If our use of AI technology materially changes in a manner that affects these practices, we will update this Privacy Policy and provide additional notice when required.

Do not submit Social Security numbers, financial-account credentials, medical information, confidential third-party information, or personal information about another person through an AI design feature unless it is necessary and you have the legal right to provide it.

Designs By Spirit may change AI technology providers from time to time. We seek to use service providers and contractual or technical safeguards appropriate to the information being processed.

7. Payment Information

When you make a purchase, payment information may be collected and processed by a third-party payment processor.

Assembly of Spirit Enterprises LLC does not intend to store complete payment-card numbers or card security codes on Designs By Spirit application servers.

We may receive limited transaction information from a payment processor, such as:

transaction identifiers;
payment status;
transaction amount;
payment method type;
limited card information such as the last four digits where provided;
billing information;
fraud or payment-verification results.

Payment processors process your information according to their own privacy and security practices and the agreements governing their services.

Square Payments and Stripe Tax

The Window Film Studio uses Square for payment checkout. We provide Square with information needed to prepare and reconcile the transaction, such as the order reference, item descriptions, prices, tax amounts, and your email address when available. Square collects payment details through its checkout and returns transaction information needed to confirm payments, handle refunds, and support orders.

When you request a final tax calculation, we send your delivery address and relevant order information, including item amounts and product tax categories, to Stripe Tax. This occurs before payment and may occur even if you do not complete the purchase. Stripe Tax calculates tax and supplies calculation references and jurisdiction details. After a completed payment or refund, related transaction references, amounts, and tax records may also be sent to or received from Stripe to support accounting, tax reporting, and reconciliation.

We retain product amounts, shipping charges, and collected tax separately in our order and payment records. For tax calculation, we do not send payment-card numbers, card security codes, or your artwork files to Stripe.

Square and Stripe process information under their applicable agreements and privacy practices, which may include processing for their own security, fraud-prevention, and legal-compliance purposes. For more information, see Square's buyer privacy notice and Stripe's Privacy Policy.

8. Information Collected Automatically

When you use our website or digital services, we and service providers acting on our behalf may automatically collect technical information.

This may include your IP address, browser, operating system, device type, referring website, pages visited, time spent on pages, links selected, approximate geographic area, error information, and similar technical data.

We use this information to:

operate and maintain the website;
understand website performance;
identify technical problems;
improve usability;
protect against unauthorized activity;
measure general website traffic and engagement;
understand how visitors use our services.

9. Cookies and Similar Technologies

Designs By Spirit uses cookies, local storage, session storage, scripts, and similar technologies when needed to operate the website and Design A View Studio.

Current uses include remembering that you dismissed the cookie notice, maintaining a passwordless authenticated session after you choose to sign in, temporarily preserving Studio progress and preferences on your device, and supporting secure transitions to and from augmented-reality views.

Authentication session information remains in browser storage until you sign out, the session expires, or you clear browser storage. Temporary augmented-reality handoff information generally lasts only for the browser session or until it is used or removed. On-device Studio recovery information may remain until you reset the Studio or clear browser storage.

The website and Studios do not currently use analytics cookies, advertising cookies, or cookies for cross-site behavioral tracking. If we introduce nonessential technologies in the future, we will update our notices and provide appropriate choices before use where required.

You can manage cookies and browser storage through your browser settings. Blocking or deleting essential storage may sign you out, remove temporary Studio recovery information, or prevent certain features from operating correctly. Additional details appear in our Cookie Policy.

10. Privacy Notices at the Point of Collection

In addition to this Privacy Policy, Designs By Spirit may provide shorter privacy notices at or before particular points where personal information is collected.

These notices may appear, where appropriate, in connection with:

account creation or sign-in;
contact or quote-request forms;
checkout and ordering;
image or artwork uploads;
AI-assisted generation features;
camera or augmented-reality access;
saved designs and projects;
Professional Network applications;
dealer, distributor, design-professional, or referral-partner registration;
marketing subscriptions.

These notices are intended to explain the information being collected and its principal purpose while providing access to this complete Privacy Policy.

A point-of-collection notice supplements this Privacy Policy and does not replace it.

11. Privacy Choices

Designs By Spirit may provide a Privacy Choices, Your Privacy Choices, or similarly labeled link or interface through which users can learn about or exercise applicable privacy options.

Where required by law and applicable to our data practices, these choices may include the ability to:

submit an access request;
request correction or deletion;
request a portable copy of personal information;
opt out of targeted advertising;
opt out of certain profiling;
opt out of sale or sharing of personal information;
submit or enable a qualifying universal opt-out preference signal.

Because Designs By Spirit does not presently intend to sell personal information or use personal information for cross-context behavioral or targeted advertising, some opt-out choices may not change the user experience because the underlying activity is not occurring.

Assembly of Spirit Enterprises LLC does not sell personal information for monetary compensation.

Designs By Spirit does not intend to use customer personal information for cross-context behavioral advertising or targeted advertising based on activity across unrelated businesses or services.

We do not knowingly sell the personal information of individuals under 16.

We do not knowingly use personal information of individuals under 16 for targeted advertising.

If we later introduce practices that constitute a "sale," "sharing," or targeted advertising under an applicable privacy law, we will update this Privacy Policy and implement any legally required notice, consent, or opt-out mechanisms before or in connection with those practices.

We may disclose information to service providers that process information on our behalf for purposes such as hosting, payments, shipping, communications, fraud prevention, analytics, customer service, image generation, and technical operations.

Those disclosures are not intended to permit the service provider to use customer information for its own independent advertising purposes.

13. How We Use Personal Information

We may use personal information to:

provide and operate Designs By Spirit products and services;
create customer accounts;
operate the Design A View Studio;
provide AI-assisted generation and visualization features;
save designs and projects at your request;
process purchases and payments;
record electronic proof approvals and verify the specifications authorized for production;
calculate applicable taxes, retain separate tax records, and reconcile payments and refunds for accounting and tax reporting;
manufacture and fulfill customized orders;
arrange shipping and delivery;
respond to questions and customer-service requests;
provide warranty, return, or order assistance;
communicate regarding transactions;
administer professional, dealer, distributor, or referral relationships;
evaluate applications to Designs By Spirit professional programs;
send requested marketing or product materials;
improve website and Studio usability;
diagnose technical issues;
prevent fraud and unauthorized activity;
maintain account and system security;
enforce our terms and agreements;
maintain business and accounting records;
establish, exercise, or defend legal claims;
comply with legal and regulatory requirements;
protect the rights, property, security, and safety of Designs By Spirit, our customers, and others.

We may also use information in aggregated or de-identified form where the information can no longer reasonably be associated with an identifiable individual.

14. Professional Network, Dealer, Distributor, and Commercial Information

Individuals and businesses participating in Designs By Spirit professional programs may provide additional information such as:

business name;
business address;
telephone number;
email address;
website;
professional role;
territory or service area;
business or resale documentation;
project and customer-order information;
marketing-material requests;
account and order history;
commission, referral, pricing, or program information where applicable;
communications with Designs By Spirit.

We use this information to administer the professional relationship, manage orders, provide authorized materials and services, communicate about the program, protect program security, and meet accounting, contractual, tax, and legal obligations.

Access to professional and administrative systems is intended to be limited according to the user's role and authorization.

15. When We Disclose Personal Information

We may disclose personal information to the following categories of recipients when reasonably necessary:

Companies that help us operate the business, such as providers of:

website or application hosting;
cloud infrastructure;
data storage;
payment processing;
tax calculation, transaction reconciliation, and tax reporting;
shipping and fulfillment;

AI or image-generation technology;
software and technical support.

Our current Studio technology providers include Supabase, which provides passwordless authentication, database services, and private artwork storage, and Vercel, which provides website and application hosting, delivery, and server-side technical operations. These providers process information on our behalf under their applicable agreements and privacy and security practices. We may change service providers as our systems evolve and will update this Policy when a change materially affects our privacy practices.

For Window Film Studio checkout, Square provides payment processing and Stripe Tax supports tax calculations and related transaction and refund tax records, as described in Section 7. We provide information relevant to those functions under the applicable service agreements.

Shipping, Manufacturing, and Fulfillment Partners

Information necessary to manufacture, prepare, ship, deliver, service, or support an order may be provided to appropriate production, fulfillment, or shipping providers.

Professional Advisers

We may disclose information to attorneys, accountants, auditors, insurers, consultants, and similar professional advisers when reasonably necessary.

Legal and Safety Purposes

We may disclose information if we reasonably believe disclosure is necessary to:

comply with applicable law, regulation, subpoena, court order, or lawful governmental request;
investigate fraud or illegal activity;
enforce our agreements;
protect our legal rights;
protect the safety, property, or security of Designs By Spirit, our customers, or others.

Business Transactions

If Assembly of Spirit Enterprises LLC is involved in a merger, acquisition, financing, restructuring, sale of assets, or similar business transaction, personal information may be disclosed as part of evaluating or completing that transaction, subject to appropriate safeguards and applicable law.

At Your Direction

We may disclose information when you request or authorize us to do so.

16. Marketing Communications

If you choose to receive promotional communications from Designs By Spirit, we may use your contact information to send information about products, Studio features, designs, services, promotions, or company news.

You can unsubscribe from promotional email by using the unsubscribe link provided in the message or by contacting us at info@designsbyspirit.com.

Transactional communications concerning an order, account, security issue, customer-service matter, warranty, or similar relationship may continue even if you unsubscribe from promotional marketing.

17. Data Retention

We retain personal information only for as long as reasonably necessary for the purposes described in this Privacy Policy.

Retention periods may depend on factors including:

whether you maintain an active account;
whether information is needed to provide a requested service;
the status of an order or project;
whether you have chosen to save a design;
warranty and customer-service needs;
legal, tax, accounting, and recordkeeping requirements;
fraud-prevention and security needs;
contractual obligations;
dispute-resolution needs;
applicable statutes of limitation.

My Designs permits up to 20 active draft designs per account. Each active draft is scheduled to expire 180 days after its latest saved activity unless you renew it by using Keep This Design or otherwise save new activity to the draft. The Studio may display reminders approximately 30 days and 7 days before expiration.

Expired drafts and their associated private artwork are scheduled for deletion. You may also delete an active draft directly through My Designs. Deleted or expired information may remain for a limited period in secure backups or logs before being overwritten in the ordinary course.

Designs associated with accepted or completed orders are not subject to the 180-day draft-expiration period. Order-related designs and records may be retained as reasonably necessary for manufacturing, fulfillment, warranty service, accounting, tax, fraud prevention, disputes, and other legal or business obligations.

Electronic proof and approval records, delivery details, tax calculations and jurisdiction breakdowns, payment records, and refund tax records are subject to these order-record retention purposes. Deleting a saved draft does not automatically delete the separate proof, order, or tax records associated with it. Records for an unfinished checkout are retained only as reasonably necessary for the purposes described above and are subject to eligible deletion requests and applicable legal exceptions.

You may request deletion of your account or other eligible personal information by contacting us as described below. Deletion requests remain subject to lawful exceptions, including records we must retain for accepted orders, accounting, security, disputes, or legal compliance.

When information is no longer reasonably required, we may delete, destroy, de-identify, or aggregate it, subject to applicable law and technical limitations associated with secure backup systems.

18. Security

Assembly of Spirit Enterprises LLC uses administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, loss, misuse, alteration, and disclosure.

Our security practices may include measures such as access controls, authentication, encryption where appropriate, separation of sensitive systems, service-provider controls, logging, monitoring, software updates, and restricted access based on legitimate business need.

Payment credentials, proprietary production systems, internal pricing logic, administrative controls, and other sensitive business functions are intended to remain separated from publicly accessible website functionality.

No Internet transmission or information-storage system can be guaranteed to be completely secure. Because My Designs uses passwordless email links, you should protect access to your email account and devices, sign out on shared devices, and notify us promptly if you believe someone has gained unauthorized access.

19. Children and Teenagers

Designs By Spirit products and services are intended primarily for adults and are not directed to children under 13.

We do not knowingly seek to collect personal information from children under 13 without legally required parental or guardian consent.

If we learn that personal information has been collected from a child under 13 in circumstances requiring parental consent and appropriate consent was not obtained, we will take reasonable steps to delete the information.

Parents or guardians who believe a child has provided personal information to us may contact us using the information in the "Contact Us" section below.

In addition, Designs By Spirit does not knowingly:

sell personal information belonging to an individual under 16;
use personal information belonging to an individual under 16 for targeted advertising; or
use such information for profiling where prohibited by applicable law.

If applicable law provides additional protections for children or teenagers, we will apply those protections as required.

20. Your Privacy Rights

Depending on where you live and the law applicable to Assembly of Spirit Enterprises LLC, you may have rights concerning your personal information.

These rights may include the right to:

confirm whether we process your personal information;
request access to personal information;
request information about the categories and sources of personal information we collect;
obtain a copy of certain personal information;
request correction of inaccurate personal information;

We may need to verify your identity before completing certain requests. Verification is intended to protect your information from unauthorized access or deletion.

Depending on the nature of the request, verification may require confirmation of information reasonably associated with your account, transaction, or prior interaction with us.

We will use information submitted for verification only for purposes relating to the privacy request, security, fraud prevention, or legal compliance.

Where applicable law allows an authorized agent to submit a request on your behalf, we may require reasonable proof that the agent is authorized to act for you and may separately verify your identity.

This section supplements the remainder of this Privacy Policy for California residents where the California Consumer Privacy Act, as amended, applies.

Assembly of Spirit Enterprises LLC does not sell personal information for monetary compensation and does not intend to use personal information for cross-context behavioral advertising.

We do not use sensitive personal information for the purpose of inferring characteristics about an individual.

Subject to applicability, exceptions, and verification requirements, California residents may have rights to know, access, correct, delete, and obtain information about personal information collected or disclosed; to opt out of sale or sharing where applicable; to limit certain uses of sensitive personal information where applicable; and to exercise privacy rights without unlawful discrimination.

Where required, an appropriate notice will be provided at or before the point at which covered personal information is collected.

23. Oregon Privacy Notice

This section supplements the remainder of this Privacy Policy for Oregon residents where the Oregon Consumer Privacy Act applies to Assembly of Spirit Enterprises LLC.

Subject to the law's applicability, exceptions, and verification requirements, Oregon residents may have rights to:

Because Designs By Spirit does not presently intend to sell personal information or use personal information for cross-context behavioral or targeted advertising, a universal opt-out signal may not produce a visible change where there is no covered activity from which to opt out.

Traditional browser "Do Not Track" settings are not necessarily the same as legally recognized universal opt-out signals.

We do not intentionally use sensitive personal information for the purpose of making inferences about highly personal characteristics.

If Designs By Spirit later introduces a product, feature, or service that intentionally collects or processes information subject to a specialized health-data privacy law, we will provide any additional or separate notice required by that law before initiating the covered processing.

Our website may contain links to websites, social-media services, installer directories, payment services, shipping services, or other resources operated by independent third parties.

For example, Designs By Spirit may provide links to independent professional installer resources for customer convenience.

A third party's collection and use of information is governed by that third party's own privacy practices, not this Privacy Policy.

A link from Designs By Spirit does not, by itself, mean Assembly of Spirit Enterprises LLC controls the third party or its privacy practices.
